Terms of Service

Welcome to Whisul! These Terms of Service (“Terms”) govern your access to and use of the Whisul website, mobile applications, and music generation services (collectively, the “Service”).
By accessing or using Whisul, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility and Accounts
- Age Requirement: You must be at least 13 years old (or the minimum age required in your country) to use Whisul.
- Account Security: You are responsible for safeguarding your password and for any activities or actions under your account.
Accuracy: You agree to provide accurate, current, and complete information during the registration process.
2. Use of the Service
Whisul grants you a personal, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose: discovering, streaming, and generating music.
2.1 Prohibited Conduct
You agree not to use Whisul to:
- Generate content that is illegal, defamatory, or promotes hate speech.
- Upload audio files or lyrics for which you do not own the rights (e.g., “deepfaking” a famous artist’s voice without permission).
- Attempt to reverse-engineer or “scrape” our AI models or proprietary algorithms.
- Use automated systems (bots) to generate mass amounts of content in violation of rate limits.
3. Content and Ownership
This section defines who owns what. Note: AI copyright law is evolving; these terms reflect current industry standards.
3.1 Your Inputs
You retain all rights to the “Inputs” you provide (text prompts, lyrics, or uploaded audio). By providing Inputs, you grant Whisul a worldwide, royalty-free license to use, host, and process them solely to provide the Service and improve our models.
3.2 Generated Content (Outputs)
- Ownership: Subject to your compliance with these Terms, Whisul hereby assigns to you all its right, title, and interest (if any) in the musical outputs generated by the Service (“Outputs”).
- Free Tier (Personal License). If you use a Free Account, Whisul grants you a limited, non-exclusive, non-transferable, revocable license to use Outputs only for personal, non-commercial purposes. Whisul retains any rights it may have in the Outputs.
- Paid Subscription (Commercial License). If you are on a Paid Subscription, Whisul grants you a non-exclusive, worldwide license to use, reproduce, distribute, publicly perform, and otherwise exploit Outputs for commercial purposes, including monetization on platforms such as Spotify, YouTube, and film/advertising synchronization, subject to these Terms and any plan limits.
- Pro Subscription (Assignment Where Possible). If you are on a Pro Subscription, then to the extent Whisul has any transferable rights in the Outputs, Whisul hereby assigns to you all such rights, title, and interest in the Outputs. For clarity, you still receive the commercial license in Section 4.
3.3 Copyright Disclaimer
Whisul does not guarantee that Outputs are protectable under copyright law. Copyright protection for AI-generated works varies by jurisdiction (e.g., the US Copyright Office currently requires “significant human authorship”). You use Outputs at your own risk regarding legal protection.
4. Fees and Payments
- Subscriptions: Some parts of the Service are billed on a subscription basis. You will be billed in advance on a recurring, periodic basis.
- Credits: Whisul may offer “Credits” for music generation. Credits are non-refundable and expire if your account is inactive for 6 months

Refunds: Except as required by law, paid subscription fees are non-refundable.
5. Termination
We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or our business interests.
6. Limitation of Liability
To the maximum extent permitted by law, Whisul shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use of the Service or any music generated therein.
Important: Whisul is provided “AS IS” and “AS AVAILABLE.” We do not warrant that the Service will be uninterrupted or error-free.
7. Indemnification
You agree to indemnify and hold harmless Whisul and its officers from any claims, damages, or expenses (including legal fees) arising from your Inputs or your violation of third-party intellectual property rights.
8. Governing Law
These Terms shall be governed by the laws of Federal Republic of Nigeria, without regard to its conflict of law provisions.
9. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the new Terms on this page. Your continued use of the Service after changes are made constitutes acceptance of the new Terms.
